Explanatory Note

This Bill

(a) requires the Governor in Council to make regulations respecting minimum building elevations and horizontal setbacks; and

(b) provides that the Act comes into force on January 1, 2024.

An Act to Amend Chapter 3
of the Acts of 2019,
the Coastal Protection Act

Be it enacted by the Governor and Assembly as follows:

1 Section 29 of Chapter 3 of the Acts of 2019, the Coastal Protection Act, is repealed and the following Sections substituted:

    29 Before the coming into force of this Act, the Governor in Council shall make regulations under clause 28(1)(h) setting standards for

    (a) minimum building elevations that comprise a system of vertical setbacks for each section of coast across the Province to protect against sea-level rise and storm surge; and

    (b) horizontal setbacks and describing the role of the designated professional with respect to horizontal setbacks.

    30 This Act has effect on and after January 1, 2024.
