Explanatory Note

This Bill provides that the Minister of Natural Resources and Renewables shall enable, and may require, forestry cleanups after natural disasters.

An Act to Amend Chapter 179
of the Revised Statutes, 1989,
the Forests Act,
Respecting Forestry Cleanups
after Natural Disasters

Be it enacted by the Governor and Assembly as follows:

1 Chapter 179 of the Revised Statutes, 1989, the Forests Act, is amended by adding immediately after Section 31 the following Section:

    31A (1) The Minister

    (a) shall ensure that members of the forestry industry are able to enter, retrieve viable wood from and clean up forests; and

    (b) may require members of the forestry industry to enter and clean up forests,

    in a timely and efficient manner after natural disasters.

    (2) The Governor in Council may make any regulations necessary to enable forest cleanups after natural disasters in accordance with subsection (1).

    (3) The exercise by the Governor in Council of the authority in subsection (2) is a regulation within the meaning of the Regulations Act.
