Explanatory Notes

Clause 1 sets out the short title of the Act.

Clauses 2 and 3 amend the Motor Vehicle Act to

(a) allow a mechanic who is not a motor vehicle inspector and does not hold an official testing station licence to invalidate a vehicle's safety approval sticker; and

(b) reduce the frequency as to when various fees must be paid.

Clause 4 amends the Wildlife Act to provide that Nova Scotia residents are not liable to pay licence or permit fees for

(a) deer hunting; or

(b) recreational fishing other than salmon fishing.

An Act to Amend Chapter 293
of the Revised Statutes, 1989,
the Motor Vehicle Act,
and Chapter 504 of the Revised Statutes, 1989,
the Wildlife Act

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Reduction in Government Fees for Hard-working Nova Scotians Act.

2 Chapter 293 of the Revised Statutes, 1989, the Motor Vehicle Act, is amended by adding immediately after Section 201 the following Section:

    201A (1) Notwithstanding Section 201, a mechanic who

    (a) is not a motor vehicle inspector appointed under Section 6; and

    (b) does not hold an official testing station license under Section 201,

    may invalidate a vehicle's safety approval sticker if the mechanic finds a safety issue with the vehicle while inspecting or repairing the vehicle.

    (2) The Governor in Council may make regulations deemed necessary or advisable to carry out effectively the intent and purpose of this Section.

    (3) The exercise by the Governor in Council of the authority in subsection (2) is a regulation within the meaning of the Regulations Act.

3 Chapter 293 is further amended by adding immediately after Section 302 the following Section:

    302A Notwithstanding anything in this Act,

    (a) a vehicle registration fee is only payable by the owner when the vehicle is first purchased by the owner either new or used;

    (b) the fee for a permit for a vehicle is only payable by the owner when the vehicle is first purchased by the owner either new or used;

    (c) a driver's license expires 10 years from the date of the initial issuance of the license, except if the Registrar determines, based on a medical opinion or the results of a medical examination, that a drivers' license expires at an earlier date;

    (d) no fee is payable for any number plates, except for the administration fee when

      (i) the plate is first issued, or

      (ii) the ownership of the vehicle is transferred; and

    (e) the registration fee for a trailer weighing up to 5,000 kilograms is only payable every two years.

4 Chapter 504 of the Revised Statutes, 1989, the Wildlife Act, is amended by adding immediately after Section 26 the following Section:

    26A Notwithstanding Section 26, no resident is liable to pay any licence or permit fee for

    (a) deer hunting; or

    (b) recreational fishing other than salmon fishing.
