Explanatory Note

This Bill

(a) clarifies the authority of The Electric Light Commissioners for Riverport, in the County of Lunenburg;

(b) broadens the purposes for which and the methods by which the Commissioners may borrow money;

(c) increases the amount the Commissioners may borrow to $1,000,000;

(d) updates references; and

(e) repeals spent statutes respecting borrowing by the Commissioners.

An Act to Amend Chapter 149
of the Acts of 1920,
The Riverport Electric Light Act
for Polling District No. 2,
in the County of Lunenburg

Be it enacted by the Governor and Assembly as follows:

1 Section 2 of Chapter 149 of the Acts of 1920, The Riverport Electric Light Act for Polling District No. 2, in the County of Lunenburg, as enacted by Chapter 76 of the Acts of 1942, is amended by adding ", as they existed immediately before the coming into force of this Section" immediately after "Municipality" in the last line.

2 Section 7 of Chapter 149 is amended by striking out "Convictions" in the sixth line and substituting "Proceedings".

3 Section 9a of Chapter 149, as enacted by Chapter 131 of the Acts of 1929, is amended by striking out "street" in the seventh line and substituting "electric".

4 Section 16 of Chapter 149 is amended by

(a) striking out "The Nova Scotia Power Commission" in the fourth line and substituting "the Nova Scotia Power Corporation"; and

(b) striking out "obtain such lighting and power system and equipment" in the seventh and eighth lines and substituting "construct, operate and maintain such electrical grid and distribution system".

5 Section 17 of Chapter 149 is amended by striking out "Board of Commissioners of Public Utilities" in the eleventh and twelfth lines and substituting "Nova Scotia Utility and Review Board".

6 Section 18 of Chapter 149 is amended by striking out "County Court" in the fifteenth line and substituting "Supreme Court of Nova Scotia".

7 Section 20 of Chapter 149 is amended by striking out "electric lighting" in the second line and substituting "electrical grid and distribution".

8 Section 21 of Chapter 149 is repealed.

9 Section 22 of Chapter 149 is amended by

(a) striking out "said debentures" in the second and third lines and substituting "any debt";

(b) striking out "shall" in the third line and substituting "may"; and

(c) striking out "not, however, to be less than one per cent. of the debentures issued and outstanding," in the sixth and seventh lines.

10 Section 23 of Chapter 149 is amended by

(a) striking out "half-yearly interest due on the debentures issued" in the seventh and eighth lines and substituting "interest due on the debt"; and

(b) striking out "the" in the ninth line and substituting "any".

11 Section 36 of Chapter 149 is repealed.

12 Section 43 of Chapter 149, as enacted by Chapter 131 of the Acts of 1929, is amended by striking out "a system or systems of street lighting for the whole or any portion of the streets or roads" in the fourth and fifth lines and substituting "an electrical grid and distribution system".

13 Clause 44(b) of Chapter 149, as enacted by Chapter 119 of the Acts of 1973, is amended by

(a) adding ", as it existed immediately before the coming into force of this clause," immediately after "Lunenburg" in the second line; and

(b) striking out "Commission" in the last line and substituting "Corporation".

14 Sections 45 and 46 of Chapter 149 are repealed and the following Section substituted:

    45 (1) Subject to subsection (3), the Commissioners may maintain, upgrade and expand the full range of the electrical infrastructure of its electrical grid and distribution system and for that purpose may raise by way of loan on the credit of the District a sum not exceeding one million dollars.

    (2) The Commissioners may borrow the sum referred to in subsection (1) through any financial mechanism including borrowing from a commercial lending institution or from a municipal, provincial or federal government or agency or any other source of funding, including grants and donations.

    (3) The Commissioners may not undertake any loan pursuant to subsection (1) until the proposed loan has been approved by a majority of the electors within the district present and voting at a meeting of the electors legally called and held.

15 Section 47 of Chapter 149, as enacted by Chapter 119 of the Acts of 1973, is amended by

(a) striking out "shall" in the first line and substituting "may";

(b) striking out "debentures" in the second line and substituting "loans";

(c) striking out "Board of Commissioners of Public Utilities" in the fourth line and substituting "Nova Scotia Utility and Review Board";

(d) striking out "debentures when the same are" in the sixth line and substituting "interest when it is"; and

(e) striking out "debentures" in the last line and substituting "loans".

16 Section 48 of Chapter 149, as enacted by Chapter 119 of the Acts of 1973, is amended by

(a) striking out "debentures" in clause (a) and substituting "loans"; and

(b) striking out "the" in clause (b) and substituting "any".

17 Section 49 of Chapter 149, as enacted by Chapter 119 of the Acts of 1973, is amended by striking out "debenture issued" in the third and fourth lines and substituting "debt incurred".

18 Section 50 of Chapter 149, as enacted by Chapter 119 of the Acts of 1973, is amended by

(a) striking out "street lighting" in the fourth line and substituting "electric grid and distribution"; and

(b) striking out everything after "thereto" in the sixth line and substituting a period.

19 Schedules A and B of Chapter 149 are repealed.

20 Chapter 110 of the Acts of 1922, An Act to Enable the Electric Light Commissioners for Riverport, in the County of Lunenburg, to Borrow Money for Electric Lighting Purposes, is repealed.

21 Chapter 75 of the Acts of 1940, An Act to Enable the Electric Light Commissioners for Riverport, in the County of Lunenburg, to Borrow Money, is repealed.
