An Act Respecting
Cellular Coverage on Highways

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Highway Cellular Coverage Act.

2 The purpose of this Act is to ensure that there is cellular telephone coverage on all highways in the Province.

3 In this Act, "Fund" means the Highway Cellular Coverage Fund established under Section 4.

4 (1) Subject to Section 6, the Minister of Public Works shall establish a Highway Cellular Coverage Fund.

(2) The Fund must be used to finance projects, prescribed by the regulations, that carry out the purpose of this Act.

5 (1) The Governor in Council may make regulations respecting the Fund, including

(a) prescribing projects for the purpose of subsection 4(2), including who will perform work on those projects;

(b) respecting target dates for establishing cellular telephone coverage;

(c) respecting target highways or targets areas of highways for establishing cellular telephone coverage;

(d) respecting payments out of the Fund;

(e) respecting any matter the Governor in Council considers necessary or advisable to carry out effectively the purpose of this Act.

(2) The exercise by the Governor in Council of the authority in subsection (1) is a regulation within the meaning of the Regulations Act.

6 The money required for the purpose of this Act must be paid out of money appropriated for that purpose by the Legislature.
