An Act to Provide Access
to Health-care Records

WHEREAS many family doctors are closing their practices;

AND WHEREAS the health-care records of doctors closing their practices need to be stored;

AND WHEREAS Nova Scotians need access to their health-care records to ensure continuity of care;

AND WHEREAS the cost of obtaining access to health-care records can be prohibitive;

THEREFORE be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Access to Health-care Records Act.

2 In this Act,

(a) "health-care record" means a patient file and includes all documents, charts, radiographs, photographic film or any other form of record relating to a patient;

(b) "Minister" means the Minister of Health and Wellness;

(c) "resident" has the same meaning as in the Health Services and Insurance Act.

3 (1) The Minister shall establish a system for storing and providing access to individual health-care records for residents.

(2) Subject to subsection (3), the cost of storing and providing access to health-care records shall be paid for by the Minister.

(3) The money required for the purpose of this Section must be paid out of money appropriated for that purpose by the Legislature.
