Explanatory Note

This Bill provides that autologous fat grafting is an insured medical service for breast cancer patients who have had a mastectomy and radiation treatment and are seeking breast reconstruction.

An Act to Amend Chapter 197
of the Revised Statutes, 1989,
the Health Services and Insurance Act,
Respecting Breast Reconstruction Coverage
for Breast Cancer Survivors

Be it enacted by the Governor and Assembly as follows:

1 Chapter 197 of the Revised Statutes, 1989, the Health Services and Insurance Act, is amended by adding immediately after Section 3 the following Section:

4 (1) In this Section, "autologous fat grafting" means harvesting and injecting an individual's own fat into the individual's soft tissue to correct contour abnormalities.

(2) Subject to subsection (3), autologous fat grafting is an insured professional service when it is provided to a breast cancer patient who has had a mastectomy and radiation treatment and who requires it for the purpose of breast reconstruction.

(3) The money required for the purpose of this Section must be paid out of money appropriated for that purpose by the Legislature.
