Explanatory Note
This Bill requires the income assistance rate for basic needs prescribed under the Employment Support and Income Assistance Act to be adjusted annually in accordance with the percentage change in the Consumer Price Index for the preceding year.
An Act to Amend Chapter 27
of the Acts of 2000,
the Employment Support and Income Assistance Act
Be it enacted by the Governor and Assembly as follows:
1 (1) Clause 21(1)(d) of Chapter 27 of the Acts of 2000, the Employment Support and Income Assistance Act, is amended by adding "subject to subsection (1A)," immediately before "prescribing" in the first line.
(2) Section 21 of Chapter 27 is further amended by adding immediately after subsection (1) the following subsections:
- (1A) Subject to subsection (1B), the maximum rate of assistance prescribed under clause (1)(d) for basic needs must be adjusted annually, commencing January 1, 2023, by applying the percentage change in the cost of living over the immediately preceding calendar year as measured by the change in the Consumer Price Index for Canada prepared by Statistics Canada.
(1B) The money required for the purpose of subsection (1A) must be paid out of money appropriated for that purpose by the Legislature.
