Explanatory Note

This Bill amends the Tourist Accommodations Registration Act to

(a) remove an exemption of a person's primary residence from registration as a short-term rental; and

(b) allow the Governor in Council to make regulations requiring compliance with land-use by-laws as a condition of registration.

An Act to Amend Chapter 9
of the Acts of 2019,
the Tourist Accommodations Registration Act

Be it enacted by the Governor and Assembly as follows:

1 Section 2 of Chapter 9 of the Acts of 2019, the Tourist Accommodations Registration Act, is amended by striking out clause (c).

2 (1) Subsection 3(1) of Chapter 9 is amended by striking out "Subject to subsection (2), no" in the first line and substituting "No".

(2) Subsection 3(2) of Chapter 9 is repealed.

3 Subsection 6(1) of Chapter 9 is amended by adding immediately after clause (b) the following clause:

    (ba) requiring compliance with applicable land-use by-laws as a condition of obtaining or maintaining registration under this Act;

4 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
