Explanatory Note

This Bill provides that police agencies may not charge for police records checks for allowing individuals to act as volunteers.

An Act to Amend Chapter 31
of the Acts of 2004,
the Police Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 31 of the Acts of 2004, the Police Act, is amended by adding immediately after Section 94 the following Section:

    94A (1) In this Section,

    (a) "police records check" means a search to be conducted of the Canadian Police Information Centre databases or another police database maintained by a police service in Canada to determine whether the databases contain entries relating to an individual and includes a criminal record check and a vulnerable sector check;

    (b) "volunteer" means a person who performs a service but who receives no compensation for doing so other than an allowance for expenses or an honorarium, and excludes a person receiving some other form of credit such as academic credit or fulfilling a sentence requirement.

    (2) An agency shall provide without charge a police records check when the police records check is being conducted for the purpose of screening an individual to allow the individual to act as a volunteer or continue acting as a volunteer.
