Explanatory Note

This Bill allows municipal traffic authorities to reduce speed limits to less than 50 kilometres per hour without provincial approval.

An Act to Amend Chapter 293
of the Revised Statutes, 1989,
the Motor Vehicle Act,
Respecting Municipal Speed Limits

Be it enacted by the Governor and Assembly as follows:

1 Section 104 of Chapter 293 of the Revised Statutes, 1989, the Motor Vehicle Act, as amended by Chapter 12 of the Acts of 1994-95 and Chapter 46 of the Acts of 2011, is further amended by adding immediately after subsection (1) the following subsections:

    (2) Notwithstanding subsection (1), a traffic authority may reduce maximum rates of speed to less than fifty kilometres per hour without the approval of the Provincial Traffic Authority.

    (3) A traffic authority shall undertake and complete a traffic study before reducing a maximum rate of speed in accordance with subsection (2).

    (4) The Provincial Traffic Authority shall provide a guide or terms of reference to traffic authorities to be considered by traffic authorities when evaluating requests or plans to reduce a maximum rate of speed in accordance with subsection (2).

    (5) The guide or terms of reference required by subsection (4) must include

    (a) an acceptable methodology to be used when undertaking an engineering analysis; and

    (b) suggestions on how to communicate the reduction in the maximum rate of speed to the public.
