Explanatory Note

This Bill limits rent increase amounts to the Consumer Price Index rate of inflation, unless the rental vacancy rate is at a sustained level of 3% or greater.

An Act to Amend Chapter 401
of the Revised Statutes, 1989,
the Residential Tenancies Act,
Respecting the Protection of Renters

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Renter Protection Act.

2 Chapter 401 of the Revised Statutes, 1989, the Residential Tenancies Act, is amended by renumbering Section 11A as Section 11AA and adding immediately before that Section the following Section:

    11A (1) Notwithstanding Section 11 and subject to subsection (3), a landlord shall not impose a rent increase by a percentage amount that is greater than the annual average percentage change for the most recent Consumer Price Index for Nova Scotia published by Statistics Canada.

    (2) Where the annual average percentage change for the most recent Consumer Price Index is below two per cent, a landlord shall not impose a rent increase that is greater than two per cent.

    (3) This Section does not apply where, in the Minister's determination, the average provincial rental vacancy rate has been at a sustained level of three per cent or greater for a period of at least one year.
