Explanatory Note

This Bill

(a) increases from six to 10 the points entered by the Registrar on the record of a person convicted of passing a school bus; and

(b) increases the fine payable by a person who is convicted of passing a school bus.

An Act to Amend Chapter 293
of the Revised Statutes, 1989,
the Motor Vehicle Act,
Respecting School Bus Safety

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Safely to School Act.

2 The POINT SYSTEM TABLE in subsection 282(2) of Chapter 293 of the Revised Statutes, 1989, the Motor Vehicle Act, as amended by Chapter 24 of the Acts of 1994, Chapters 12 and 44 of the Acts of 2001, Chapter 20 of the Acts of 2002, Chapters 20 and 45 of the Acts of 2007, Chapter 21 of the Acts of 2008, Chapter 61 of the Acts of 2010, Chapter 46 of the Acts of 2011, Chapter 53 of the Acts of 2014 and Chapter 45 of the Acts of 2015, is further amended by striking out item 6. and substituting the following items:

    6. Passing school bus 103(3) 10

    6A. Failure to obey 125A 6

    crossing guard

3 Section 297 of Chapter 293, as enacted by Chapter 10 of the Acts of 2002 and amended by Chapter 42 of the Acts of 2004, Chapter 8 of the Acts of 2005, Chapter 45 of the Acts of 2007, Chapter 60 of the Acts of 2010, Chapter 53 of the Acts of 2014 and Chapter 45 of the Acts of 2015, is further amended by striking out "subsection (3) of Section 103," in the third line.

4 Chapter 293 is further amended by adding immediately after Section 300B the following Section:

    300C Any person who violates subsection (3) of Section 103 is guilty of an offence and liable on summary conviction to a maximum fine of $5,000.
