Explanatory Note

This Bill amends the Workers' Compensation Act to provide that earnings-replacement benefits for former workers of the Cape Breton Development Corporation's underground coal mine do not expire at age 65 so long as those benefits are reimbursed by the Government of Canada. The Bill is retroactive to January 1, 2016.

An Act to Amend Chapter 10
of the Acts of 1994-95,
the Workers' Compensation Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 37(9) of Chapter 10 of the Acts of 1994-95, the Workers' Compensation Act, is amended by striking out "subsection (10)" in the first line and substituting "subsections (10) and (10A)".

(2) Section 37 of Chapter 10, as amended by Chapter 1 of the Acts of 1999, is further amended by adding immediately after subsection (10) the following subsections:

(10A) Subject to subsection (10B), clause (9)(b) does not apply to a former worker of the Cape Breton Development Corporation's underground coal mine covered under the Government Employees Compensation Act (Canada).

(10B) Subsection (10A) only applies to the extent that the Government of Canada reimburses the Accident Fund for any additional benefits that accrue as a result of that subsection.

2 This Act has effect on and after January 1, 2016.
