Explanatory Note
This Bill requires proof of immunization for children attending schools or pre-primary education in Nova Scotia, unless a medical exemption is provided.
An Act to Amend Chapter 4
of the Acts of 2004,
the Health Protection Act
1 Chapter 4 of the Acts of 2004, the Health Protection Act, is amended by adding immediately after Section 73 the following Section:
- 73A (1) In this Section, "regional centre", "regional executive director of education" and "private school" have the same meanings as in the Education Act.
(2) The regional executive director of education for a regional centre shall require that proof of immunization is provided to him or her for any disease prescribed by the regulations for a child attending a school of the regional centre for the first time.
(3) The superintendent of the Conseil scolaire acadien provincial shall require that proof of immunization is provided to him or her for any disease prescribed by the regulations for a child attending a school of the Conseil for the first time.
(4) The person in charge of a private school shall require that proof of immunization is provided to him or her for any disease prescribed by the regulations for a child attending the school for the first time.
(5) A person operating a pre-primary program in accordance with the Pre-primary Education Act shall require that proof of immunization is provided to him or her for any disease prescribed by the regulations for a child attending the pre-primary program for the first time.
(6) A person referred to in subsections (2) to (5) shall not permit a child to attend the school or program unless proof of immunization is provided for the child.
(7) Notwithstanding subsections (2) to (6), proof of immunization is not required if the parent or legal guardian of a child provides a medical exemption, on a form provided by the Minister, signed by a physician.
2 Section 74 of Chapter 4, as amended by Chapter 32 of the Acts of 2014, is further amended by adding immediately after clause (ak) the following clause:
- (aka) prescribing diseases for the purpose of subsections 73A(2) to (5);
