Explanatory Note

This Bill requires education entities to provide

(a) all public schools in the Province with epinephrine and automated external defibrillators;

(b) all junior and senior high schools with naloxone kits;

(c) training in the use of epinephrine, an automated external defibrillator and naloxone for school personnel; and

(d) indemnification for school personnel who are required to use epinephrine, an automated external defibrillator or naloxone in the course of their duties.

An Act to Amend Schedule A
of Chapter 1 of the Acts of 2018,
the Education Act,
Respecting Emergency Aid at School

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Emergency Aid at School Act.

2 Schedule A of Chapter 1 of the Acts of 2018, the Education Act, is amended by adding immediately before the Heading for Section 54 the following Heading and Sections:

EMERGENCY AID AT SCHOOL

    53G In Sections 53H to 53M,

    (a) "junior high school" means a public school with a grade configuration above fifth grade and no higher than 10th grade;

    (b) "senior high school" means a public school with a grade configuration above 9th grade.

    53H An education entity shall provide and maintain for every public school in the school region under its jurisdiction

    (a) a supply of epinephrine; and

    (b) an automated external defibrillator.

    53I An education entity must provide and maintain a supply of naloxone kits for every junior high school and senior high school in the school region under its jurisdiction.

    53J An eduction entity shall train principals, vice-principals and designated staff in the administration of epinephrine and the use of automated external defibrillators.

    53K An education entity shall train junior high school and senior high school principals, vice-principals and designated staff in the use of a naloxone kit.

    53L No action for damages or other proceeding may be brought against a principal, vice-principal or designated staff member acting in good faith who administers epinephrine, an automated external defibrillator or a naloxone kit to a person on school property.

    53M (1) The Minister may make regulations designating staff who may administer epinephrine or use an automated external defibrillator or a naloxone kit.

    (2) The exercise by the Minister of the authority contained in subsection (1) is a regulation within the meaning of the Regulations Act.
