Explanatory Note

This Bill requires the Governor in Council to take into account the cost of purchasing Health Canada's National Nutritious Food Basket when prescribing the standards for assistance to be granted, or the maximum rates of assistance that may be granted, to a family with one or more dependent children.

An Act to Amend Chapter 27
of the Acts of 2000,
the Employment Support and Income Assistance Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Subsection 21(1) of Chapter 27 of the Acts of 2000, the Employment Support and Income Assistance Act, is amended by

(a) adding "subject to subsection (1A)," immediately before "prescribing" in the first line of clause (c); and

(b) adding "subject to subsection (1A)," immediately before "prescribing" in the first line of clause (d).

(2) Section 21 of Chapter 27 is further amended by adding immediately after subsection (1) the following subsection:

    (1A) When making regulations prescribing

    (a) the standards for assistance to be granted; or

    (b) the maximum rates of assistance that may be granted,

    to a family with one or more dependent children, the Governor in Council shall take into account any data available to the Governor in Council respecting the cost, for a person in the Province, to purchase the food contained in the National Nutritious Food Basket, as determined by the Department of Health (Canada).
