Explanatory Note

This Bill

(a) requires the provincial health authority and community health boards to work together in the preparation of health-service business plans as they relate to community health boards; and

(b) requires community health board members to keep information relating to those discussions confidential.

An Act to Amend Chapter 32
of the Acts of 2014,
the Health Authorities Act,
to Strengthen Community Health Boards

Be it enacted by the Governor and Assembly as follows:

1 Section 40 of Chapter 32 of the Acts of 2014, the Health Authorities Act, is amended by adding immediately after subsection (2) the following subsection:

    (2A) The provincial health authority shall collaborate with the community health boards on that part of the health-services business plan relating to community health boards.

2 Chapter 32 is further amended by adding immediately after Section 70 the following Section:

    70A (1) In order to carry out its duties under Section 70, the members of a community health board shall participate in the preparation of the health-services business plan with the provincial health authority as it relates to community health boards.

    (2) The members of a community health board shall keep confidential all information discussed and obtained under subsection (1) except information that

    (a) is in the public domain at the time it is obtained; or

    (b) comes into the public domain after it has been obtained, other than by virtue of a breach of this subsection.
