Explanatory Note

This Bill requires a public body to notify every individual or group whose personal information has been compromised.

An Act to Amend Chapter 5
of the Acts of 1993,
the Freedom of Information
and Protection of Privacy Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 5 of the Acts of 1993, the Freedom of Information and Protection of Privacy Act, is amended by adding immediately after Section 31 the following Section:

    31A A public body shall notify as soon as is practicable every individual or group of individuals whose personal information controlled or managed by the public body has or may have been compromised.
