Explanatory Notes

Clause 1 prohibits the reduction of assistance on the basis of an applicant being enrolled in a prescribed post-secondary education program.

Clause 2 allows the Governor in Council to make regulations prescribing post-secondary education programs and classes of post-secondary education programs.

An Act to Amend Chapter 27
of the Acts of 2000,
the Employment Support and Income Assistance Act

Be it enacted by the Governor and Assembly as follows:

1 Section 7 of Chapter 27 of the Acts of 2000, the Employment Support and Income Assistance Act, is amended by adding immediately after subsection (2) the following subsection:

    (3) A determination under subclause 7(2)(b)(i) or (ii) and a review under subclause 7(2)(b)(vi) must not reduce the assistance to which an applicant would otherwise be eligible on the basis that the applicant is enrolled in a prescribed post-secondary education program.

2 Subsection 21(1) of Chapter 27 is amended by adding immediately after clause (l) the following clause:

    (la) prescribing post-secondary education programs or classes of post-secondary education programs for the purpose of subsection 7(3);
