Explanatory Notes
Clauses 1 and 2 require that health cards not indicate the sex, gender identity or gender expression of their holder.
Clause 3 provides an option for an “X” on driver’s licenses in place of the indicator of sex.
An Act Respecting
Gender-neutral Identification
1 Chapter 197 of the Revised Statutes, 1989, the Health Services and Insurance Act, is amended by adding immediately after Section 3 the following Section:
- 4 (1) Any card or other evidence of insurance provided to a resident in respect of insured services under this Act must not indicate the resident’s sex, gender identity or gender expression.
(2) Where a resident has been provided a card or other evidence of insured services that indicates the resident’s sex, gender identity or gender expression and the resident requests a replacement, a replacement must be provided to the resident at no cost.
2 Chapter 44 of the Acts of 2012, the Insured Health Services Act, is amended by adding immediately after Section 7 the following Section:
- 7A (1) Any card or other evidence of insurance provided to a resident in respect of insured services under this Act must not indicate the resident’s sex, gender identity or gender expression.
(2) Where a resident has been provided a card or other evidence of insured services that indicates the resident’s sex, gender identity or gender expression and the resident requests a replacement, a replacement must be provided to the resident at no cost.
- (2A) Every driver’s license must bear thereon an indicator of the sex of the holder of the license or, where the holder of the license so elects, an “X” in place of that indicator.
(2B) The Department shall issue a replacement license, at no cost to the holder of the license, if the existing license indicates the sex of the holder of the license and the holder of the license requests to have an “X” in place of the indicator of the holder’s sex.
