Explanatory Note

This Bill allows a municipal council to make a by-law directing the traffic authority for the municipality to set lower speed limits than that provided under Section 102 of the Motor Vehicle Act (50 km/h) without the approval of the Provincial Traffic Authority, which approval is normally required under Section 104 of the Act.

An Act to Amend Chapter 293
of the Revised Statutes, 1989,
the Motor Vehicle Act,
Respecting the Fixing of Speed Limits
by Traffic Authorities of Municipalities

Be it enacted by the Governor and Assembly as follows:

1 Subsection 104(1) of Chapter 293 of the Revised Statutes, 1989, the Motor Vehicle Act, as amended by Chapter 46 of the Acts of 2011, is further amended by striking out “Section 103” in the first and second lines and substituting “Sections 103 and 104A”.

2 Chapter 293 is further amended by adding immediately after Section 104 the following Section:

104A (1) The council of a city or town may make a by-law directing the traffic authority for the city or town to, in accordance with the by-law, fix maximum rates of speed under Section 104 that are lower than the speed limitations provided in subsection (2) of Section 102.

(2) The approval of the Provincial Traffic Authority is not required when the traffic authority for a city or town fixes maximum rates of speed under Section 104 in accordance with a by-law made under subsection (1), or when erecting and maintaining signs containing notification of such rate of speed.
