Explanatory Note

This Bill requires that, when a child is in the care of an agency, the subject of an adoption agreement with an agency or a party to a services or placement agreement with the Minister of Community Services, the agency or the Minister, as the case may be, must investigate whether the child has Canadian citizenship and, if not, attempt to obtain citizenship for the child.

An Act to Amend Chapter 5
of the Acts of 1990,
the Children and Family Services Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 5 of the Acts of 1990, the Children and Family Services Act, is amended by adding immediately after Section 30 the following Section:

    30A Where a child is

    (a) in the care and custody of an agency or the subject of an adoption agreement to which an agency is a party; or

    (b) a party to a services agreement with the Minister under Section 19 or a placement agreement with the Minister under Section 19A,

    the agency or Minister, as the case may be, has a duty to promptly investigate the citizenship status of the child and, where it appears that the child is not a citizen of Canada, shall and is authorized to take all steps necessary to obtain Canadian citizenship for the child in accordance with the laws of Canada.
