An Act Respecting Road Safety Awareness
and to Amend Chapter 293
of the Revised Statutes, 1989,
the Motor Vehicle Act

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as Frankie’s Law.

2 Throughout the Province, in each and every year, September 12th shall be kept and observed under the name of First Responder Road Safety Awareness Day.

3 The Minister of Transportation and Infrastructure Renewal shall cause signs to be placed on all 100-series highways in the Province informing drivers of the requirement to

(a) reduce their vehicle’s speed to no more than 60 kilometres per hour when passing an emergency vehicle stopped and exhibiting a flashing light; and

(b) not drive in the traffic lane occupied, or partly occupied, by emergency vehicle stopped and exhibiting a flashing light, or in the traffic lane closest to and not occupied, or partly occupied, by the emergency vehicle, if there is another traffic lane, for traffic moving in the same direction as the emergency vehicle and further from the emergency vehicle, into which the vehicle can safely move.

4 Subsection 106D(1) of Chapter 293 of the Revised Statutes, 1989, the Motor Vehicle Act, as enacted by Chapter 20 of the Acts of 2009 and amended by Chapter 20 of the Acts of 2014, is further amended by adding immediately after clause (ba) the following clause:

    (bb) a tow truck or recovery vehicle;

5 Subsection 106E(1) of Chapter 293, as enacted by Chapter 20 of the Acts of 2009, is amended by adding “for any reason” immediately after “it” in the third line.

6 Subsection 106F(1) of Chapter 293, as enacted by Chapter 20 of the Acts of 2009, is amended by adding “for any reason” immediately after “light” in the second line.
