Explanatory Notes
Clause 1 adds a definition of "Minister".
Clause 2 removes a reference to an outdated title of the Minister.
Clause 3
(a) clarifies the meaning of a clause permitting the Governor in Council to make regulations with respect to any enactment that applies to the pre-primary program; and
(b) allows the Governor in Council to make regulations with respect to agreement-making powers in relation to a pre-primary program.
Clause 4 adds two new Sections that allow
(a) the Minister to enter into agreements with respect to the establishment, delivery and funding of a pre-primary program; and
(b) a school board to offer a pre-primary program and enter into an agreement for its delivery, with the approval of the Minister and subject to the regulations.
An Act to Amend Chapter 44
of the Acts of 2005,
the Pre-primary Education Act
Be it enacted by the Governor and Assembly as follows:
1 Chapter 44 of the Acts of 2005, the Pre-primary Education Act, is amended by adding immediately after Section 1 the following Section:
2 Section 2 of Chapter 44 is amended by striking out "of Education" in the first line.
3 Subsection 3(1) of Chapter 44 is amended by
(a) striking out "or of any other" in the first line of clause (e) and substituting "of any"; and
(b) adding immediately after clause (e) the following clause:
4 Chapter 44 is further amended by adding immediately after Section 3 the following Sections:
3B (1) Notwithstanding the Education Act, a school board may, with the approval of the Minister and subject to the regulations, offer a pre-primary program.
(2) With the approval of the Minister and subject to the regulations, a school board may enter into an agreement with a person, agency, organization, association, institution, municipality or other body respecting the delivery of a pre-primary program or related services.
