Explanatory Note

This Bill amends the Safe Collection of Scrap Metal Act to prohibit the purchase of copper pipe used to transmit home heating oil by a scrap-metal dealer or recycler.

An Act to Amend Chapter 45
of the Acts of 2011,
the Safe Collection of Scrap Metal Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 45 of the Acts of 2011, the Safe Collection of Scrap Metal Act, is amended by adding immediately after Section 4 the following Section:

4A No person may sell to a scrap-metal dealer or recycler and no scrap-metal dealer or recycler may accept anything that is, or would appear to a reasonable person who had made diligent inquiries to be, a copper pipe used to transmit home heating oil, unless the seller holds a valid certificate of qualification as an installer pursuant to the Petroleum Management Regulations under the Environment Act.
