Explanatory Notes
Clauses 1 and 2 provide for the appointment and describe the duties of a Registrar of Teacher Certification.
Clause 3 repeals references to the former Nova Scotia Teachers College and removes the authority of the Minister to classify teachers and grant teachers' certificates and permits.
Clause 4 repeals a reference to the former Nova Scotia Teachers College.
Clause 5 empowers the Governor in Council to make regulations respecting the duties of the Registrar.
Clause 6 provides for the Clauses respecting the Registrar to come into force on proclamation.
An Act to Amend Chapter 1
of the Acts of 1995-96,
the Education Act,
Respecting Teachers
Be it enacted by the Governor and Assembly as follows:
1 Subsection 3(1) of Chapter 1 of the Acts of 1995-96, the Education Act, as amended by Chapter 11 of the Acts of 2000, Chapter 16 of the Acts of 2005 and Chapter 37 of the Acts of 2010, is further amended by adding immediately after clause (ac) the following clause:
2 Chapter 1 is further amended by adding immediately after Section 27 the following Sections:
(2) Where the Registrar is absent or incapacitated, or where the office of the Registrar is vacant, the Minister may appoint an employee of the Department of Education to act as the Registrar.
27B The Registrar shall, in accordance with the regulations,
(a) classify teachers;
(b) grant teacher's certificates;
(c) grant teaching permits; and
(d) perform such other duties and functions as are prescribed by the regulations.
3 (1) Clauses 141(b), (c) and (d) of Chapter 1 are repealed.
(2) Clause 141(e) of Chapter 1 is repealed.
4 Clause 145(1)(r) of Chapter 1 is repealed.
5 Subsection 146(1) of Chapter 1, as amended by Chapter 11 of the Acts of 2000, Chapter 5 of the Acts of 2002, Chapter 3 of the Acts of 2004, Chapter 4 of the Acts of 2004, Chapter 16 of the Acts of 2005, Chapter 27 of the Acts of 2006 and Chapter 53 of the Acts of 2008, is further amended by adding immediately after clause (d) the following clause:
6 Sections 1 and 2, subsection 3(2) and Section 5 come into force on such day as the Governor in Council orders and declares by proclamation.
