An Act to Require
the Government of Nova Scotia
to Purchase Agricultural Products
from Nova Scotia Producers

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Buy Nova Scotia First Act.

2 In this Act, "local produce" means food items grown, raised, caught, harvested, produced or manufactured in the Province and includes any food items designated in the regulations as local produce.

3 This Act binds Her Majesty in right of the Province.

4 Subject to Section 7, where the Nova Scotia Government Purchasing Agency or any department or office of the public service, within the meaning of the Public Service Act, buys food items to supply the operations carried out by a department or office, it shall give preference to the purchase of local produce and shall purchase local produce in accordance with the regulations made under this Act.

5 (1) The Governor in Council may make regulations

(a) designating food items as local produce for the purpose of this Act;

(b) further defining "local produce";

(c) respecting the purchase of local produce by the Nova Scotia Government Purchasing Agency, departments and offices;

(d) respecting the manner in which the Nova Scotia Government Purchasing Agency, departments and offices are to give preference to the purchase of local produce;

(e) defining any word or expression used but not defined in this Act;

(f) respecting any matter or thing the Governor in Council considers necessary or advisable to carry out effectively the intent and purpose of this Act.

(2) The exercise by the Governor in Council of the authority contained in subsection (1) is regulations within the meaning of the Regulations Act.

6 The Government shall, within ninety days after this Act received Royal Assent, make public draft regulations for the purpose of this Act, including regulations further defining "local produce" with respect to agricultural and aquacultural production within the Province.

7 The moneys required for the purpose of this Act shall be paid out of moneys appropriated for that purpose by the Legislature.
