Explanatory Notes

Clause 1 permits the Bridgewater Public Service Commission to supply water to areas outside of the Town boundaries of Bridgewater.

Clauses 2 and 3 increase the membership of the Commission by one and ensure that at least two members are not Town Council members.

Clause 4 provides that if the Commission is dissolved, its assets and liabilities remain vested in the Town.

Clause 5 gives retrospective effect to Section 4.

An Act to Amend Chapter 59
of the Acts of 1993,
An Act Respecting the Public Service
Commission of Bridgewater

Be it enacted by the Governor and Assembly as follows:

1 Section 3 of Chapter 59 of the Acts of 1993, An Act Respecting the Public Service Commission of Bridgewater, is amended by

(a) adding "(1)" immediately after the Section number; and

(b) adding the following subsection:

(2) Notwithstanding subsection (1), the Commission may supply water to areas outside of the Town boundaries.

2 (1) Subsection 4(1) of Chapter 59 is amended by striking out "five" in the first line and substituting "six".

(2) Section 4 of Chapter 59 is further amended by adding immediately after subsection (4) the following subsection:

(5) At least two members appointed to the Commission by the Council must be persons who are not members of the Council.

3 Subsection 6(1) of Chapter 59 is amended by striking out "five" in the second line and substituting "six".

4 Section 14 of Chapter 59 is amended by adding immediately after subsection (3) the following subsection:

(4) In the event of the dissolution of the Commission, all assets and liabilities of the Commission vest in the Town.

5 Section 4 has effect on and after November 25, 1993.
