Explanatory Note

This Bill enables the installation and use of crosswalk flags at certain crosswalks as determined by a local traffic authority.

An Act to Amend Chapter 293
of the Revised Statutes, 1989,
the Motor Vehicle Act

Be it enacted by the Governor and Assembly as follows:

1 Section 2 of Chapter 293 of the Revised Statutes, 1989, the Motor Vehicle Act, as amended by Chapter 24 of the Acts of 1994, Chapter 12 of the Acts of 1994-95, Chapter 23 of the Acts of 1995-96, Chapter 12 of the Acts of 2001, Chapter 20 of the Acts of 2002, Chapter 42 of the Acts of 2004, Chapter 35 of the Acts of 2006, Chapter 20 of the Acts of 2007, Chapter 45 of the Acts of 2007 and Chapter 21 of the Acts of 2008, is further amended by adding immediately after clause (h) the following clause:

(ha) "crosswalk flag" means a rectangular-shaped reflective-orange flag used by a pedestrian at a crosswalk to signal an intent to cross the roadway;

2 Section 125 of Chapter 293, as enacted by Chapter 45 of the Acts of 2007, is amended by adding immediately after subsection (4) the following subsections:

(4A) The traffic authority may install and maintain, or cause to be installed and maintained, crosswalk flags at crosswalks.

(4B) Where a pedestrian is crossing a roadway at a crosswalk with a crosswalk flag pursuant to subsection (4A), the pedestrian may display the flag before crossing the roadway and while in the crosswalk and, where the pedestrian displays the flag, the pedestrian shall deposit the flag in the receptacle provided upon leaving the crosswalk.

(4C) It is an offence for a person, other than a traffic authority or a person acting under the direction of a traffic authority, to remove or take a crosswalk flag other than in accordance with subsection (4B).

(4D) The Governor in Council may make regulations respecting the specifications, installation, maintenance and use of crosswalk flags.

(4E) The exercise by the Governor in Council of the authority contained in subsection (4D) is regulations within the meaning of the Regulations Act.

3 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
