Explanatory Note

This Bill amends the Public Service Act to confirm by statute the previous establishment of the Department of Environment.

An Act to Amend Chapter 376
of the Revised Statutes, 1989,
the Public Service Act,
Respecting the Environment

Be it enacted by the Governor and Assembly as follows:

1 Section 2 of Chapter 376 of the Revised Statutes, 1989, the Public Service Act, as amended by Chapter 14 of the Acts of 1992, Chapter 38 of the Acts of 1993, Chapter 31 of the Acts of 1994, Chapter 1 of the Acts of 1995-96, Chapter 8 of the Acts of 1996, Chapter 25 of the Acts of 1996, Chapter 4 of the Acts of 2001, Chapter 2 of the Acts of 2006 and Chapter 44 of the Acts of 2006, is further amended by striking out clause (e) and substituting the following clause:

(e) the Department of Environment;

2 The heading immediately before Section 37 and Sections 37 and 38 of Chapter 376 are repealed and the following heading and Sections substituted:

DEPARTMENT OF ENVIRONMENT

37 The Department of Environment shall be presided over by the Minister of Environment who has the supervision, direction and control of all affairs and matters relating to the Department and who shall supervise the performance of the functions of the Department.

38 The Minister of Environment has, unless specifically assigned to another member of the Executive Council, the supervision, direction and control of all matters relating to

(a) the supervision, management, preservation and protection of the environment, including protected areas;

(b) leadership, coordination and reporting on environmental goals and sustainability;

(c) the administration of Acts, orders and regulations relating to the matters referred to in clauses (a) and (b); and

(d) such other matters as may be assigned to the Minister by the Governor in Council or by statute.

39 The Minister of Environment is the lead member of the Executive Council with respect to climate-change matters.

3 This Act comes into force on such day as the Governor in Council orders and declares by proclamation.
