Explanatory Note

This Bill provides that no person shall drive a vehicle on a highway at a speed greater than 50 kilometres per hour when passing an emergency vehicle or an accident.

An Act to Amend Chapter 293
of the Revised Statutes, 1989,
the Motor Vehicle Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 293 of the Revised Statutes, 1989, the Motor Vehicle Act, is amended by adding immediately after Section 107B the following Section:

107C (1) No person shall drive a vehicle on a highway at a speed in excess of fifty kilometres per hour when passing an accident or an emergency vehicle that is stopped on the highway with its emergency lights in operation.

(2) Subsection (1) does not apply where a vehicle is being driven on a highway that is divided into two separate roadways by a median and the vehicle is travelling on the opposite roadway from the accident or emergency vehicle.

2 Section 295 of Chapter 293, as amended by Chapter 36 of the Acts of 1990, Chapter 12 of the Acts of 1994-95, Chapter 23 of the Acts of 1995-96, Chapter 34 of the Acts of 1996, Chapter 11 of the Acts of 1999, Chapter 12 of the Acts of 2001 and Chapter 10 of the Acts 2002, is further amended by adding ", 107C" immediately after "107A" in the second line.
