Explanatory Notes

Clause 1 requires every employer to establish and implement a policy to prevent bullying in the workplace.

Clause 2 authorizes the Governor in Council to make a regulation respecting criteria for a bullying-prevention policy.

An Act to Amend Chapter 7
of the Acts of 1996,
the Occupational Health and Safety Act

Be it enacted by the Governor and Assembly as follows:

1 Subsection 13(2) of Chapter 7 of the Acts of 1996, the Occupational Health and Safety Act, is amended by adding immediately after clause (c) the following clause:

(ca) in accordance with the regulations, if any, establish and implement a policy to prevent bullying in the workplace;

2 Subsection 82(1) of Chapter 7 is amended by adding immediately after clause (h) the following clause:

(ha) respecting the criteria for a policy to prevent bullying in the workplace;
