Explanatory Note

This Bill amends the Public Highways Act to require shoulder-line rumble strips on all new 100-series highways and to require the Minister of Transportation and Public Works to establish a plan for the placement of shoulder-line rumble strips on existing 100-series highways.

An Act to Amend Chapter 371
of the Revised Statutes, 1989,
the Public Highways Act

Be it enacted by the Governor and Assembly as follows: 1 Chapter 371 of the Revised Statutes, 1989, the Public Highways Act, is amended by adding immediately after Section 25 the following Section:

25A (1) Subject to subsection (5), highway shoulder-line rumble strips must be placed on all newly constructed 100-series highways constructed pursuant to this Act.

(2) Subject to subsection (5), the Minister of Transportation and Public Works shall, within one year after the coming into force of this Section, establish a plan for the placement of shoulder-line rumble strips on all existing 100-series highways other than those referred to in subsection (1).

(3) The Governor in Council may make regulations

(a) exempting, in whole or in part, a 100-series highway from the provisions of subsection (1);

(b) defining any word or expression used but not defined in this Section;

(c) considered necessary or advisable by the Governor in Council to carry out effectively the intent and purpose of this Section.

(4) The exercise by the Governor in Council of the authority contained in subsection (3) is regulations within the meaning of the Regulations Act.

(5) The sums required for the purpose of this Section shall be paid out of money appropriated by the Legislature for that purpose.
