Explanatory Note

This Bill places a moratorium on the permanent closure of public schools until September 1, 2008, and requires the Minister of Education to establish, on or before August 1, 2006, a committee to review the role of public schools in the community.

An Act to Amend Chapter 1
of the Acts of 1995-96,
the Education Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 1 of the Acts of 1995-96, the Education Act, is amended by adding immediately after Section 89 the following Sections:

89A Notwithstanding anything contained in this Act, no school board shall, between the coming into force of this Section and September 1, 2008, make a by-law governing the permanent closure of a public school within its jurisdiction.

89B (1) The Minister shall, on or before August 1, 2006, establish a committee to review the role of public schools in the community.

(2) The committee shall be composed of one representative from each of

(a) the Department of Education;

(b) Health Promotion and Protection;

(c) the Department of Transportation and Public Works;

(d) the Department of Justice;

(e) the Department of Economic Development;

(f) the Union of Nova Scotia Municipalities;

(g) the Nova Scotia School Board Association; and

(h) the Nova Scotia Home and School Association.

(3) The committee shall make a report to the Minister no later than August 1, 2007.

(4) The Minister shall table a copy of the report referred to in subsection (3) in the House of Assembly, if the House is sitting, and, if the House is not sitting, the Minister shall file the report with the Chief Clerk of the House.
