Explanatory Note

This Bill provides that, effective six months after the Bill receives Royal Assent,

(a) domestic class pesticides must be stored, handled and maintained in accordance with the regulations; and

(b) a spill of a domestic class pesticide must be cleaned up as provided in the regulations.

An Act to Amend Chapter 1
of the Acts of 1994-95,
the Environment Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 1 of the Acts of 1994-95, the Environment Act, is amended by adding immediately after Section 101 the following Section:

101A (1) A domestic class pesticide available in retail outlets in the Province shall be stored, handled and maintained as set out in the regulations.

(2) A spill of a domestic class pesticide shall be cleaned up following the procedures set out in the regulations.

2 Subsection 102(1) of Chapter 1 is amended by adding immediately after clause (h) the following clause:

(ha) respecting the storage, handling, maintaining and clean-up of domestic class pesticides;

3 This Act comes into force six months after it receives Royal Assent.
