Explanatory Note

This Bill prohibits an employer from taking an employee's tips.

An Act Amend Chapter 246
of the Revised Statutes, 1989,
the Labour Standards Code

Be it enacted by the Governor and Assembly as follows:

1 Chapter 246 of the Revised Statutes, 1989, the Labour Standards Code, is amended by adding immediately after Section 80 the following Section:

80A No employer shall ask for, demand, require an accounting of or take any part of an employee's gratuities or tips or take into consideration the amount of any gratuities or tips in calculating an employee's pay.

2 Clause 81(a) of Chapter 246, as amended by Chapter 14 of the Acts of 1991, is further amended by striking out "and 80" in the fourth line and substituting ", 80 and 80A".
