Explanatory Note

This Bill adds a definition of "wetland".

An Act to Amend Chapter 1
of the Acts of 1994-95,
the Environment Act

Be it enacted by the Governor and Assembly as follows:

1 Section 3 of the Acts of 1994-95, the Environment Act, as amended by Chapter 6 of the Acts of 2001, is further amended by

(a) striking out the period at the end of clause (bf) and substituting a semicolon; and

(b) adding immediately after clause (bf) the following clause:

(bg) "wetland" means land that is saturated with water for a period of time long enough to promote wetland or aquatic processes that are evidenced by poorly drained soils, hydrophytic vegetation and biological activities adapted to a wet environment.
