Explanatory Note

This Bill makes the Freedom of Information and Protection of Privacy Act applicable to Emergency Medical Care Inc., Medavie Blue Cross, home-care agencies and operators of nursing homes to the extent of their business carried on respecting agreements with or on behalf of the Government of Nova Scotia.

An Act to Amend Chapter 5
of the Acts of 1993,
the Freedom of Information and
Protection of Privacy Act

Be it enacted by the Governor and Assembly as follows:

1 (1) Section 4 of Chapter 5 of the Acts of 1993, the Freedom of Information and Protection of Privacy Act, as amended by Chapter 11 of the Acts of 1999 (2nd Session), is further amended by adding immediately after subsection (1) the following subsection:

(1A) This Act applies to

(a) Emergency Medical Care Inc.;

(b) Medavie Blue Cross;

(c) home-care agencies; and

(d) operators of nursing homes,

to the extent of their business carried on respecting agreements with or on behalf of the Government of the Province or an agent thereof and, for the purpose of this subsection, in this Act "public body" includes the bodies referred to in clauses (a) to (d).

(2) Subsection 4(2) of Chapter 5 is amended by adding "or (1A)" immediately after "(1)" in the first line.
