Retiring Allowance Act

Be it enacted by the Governor and Assembly as follows:
1 This Act may be cited as the Lenihan (Municipality of the District of Chester) Retiring Allowance Act.
3 (1) Notwithstanding any enactment, the Municipality shall pay to Barry Lenihan, retiring Chief Administrative Officer, a supplementary retiring allowance in monthly instalments and the amount of each instalment, to be paid on the first day of each month as provided in subsection (2), shall be one hundred and ninety-five dollars.
(2) The first of the monthly payments referred to in subsection (1) shall be made on the first day of the month commencing March 31, 2004, and shall continue thereafter during his life, including the month in which he dies.
(3) If Barry Lenihan's wife, Mona Lenihan, survives him the supplementary retiring allowance shall continue to be paid to her commencing the first day of the month immediately following the month in which Barry Lenihan dies until her death at a monthly rate of sixty-six and two-thirds per cent of the amount specified in subsection (1).
4 On and after the first day of March in each year, the supplementary retiring allowance payable pursuant to this Act shall be increased over the allowance payable in the preceding year by the percentage increase in the cost of living as measured by the Consumer Price Index for Canada prepared by Statistics Canada for the immediately preceding year to a maximum of six per cent per year.
5 All sums required for payment pursuant to this Act shall be held to be sums required for the ordinary lawful purposes of the Municipality and shall be raised, levied and collected in the same manner and in all respects as other sums required for the ordinary lawful purposes of the Municipality are raised, levied and collected.
6 This Act is binding on the Municipality and upon any other municipality or local or other government that may hereafter become a successor to the Municipality or that assumes any or all of the relevant functions thereof.
