An Act to Ensure Clear Grocery Pricing
Be it enacted by the Governor and Assembly as follows:
1 This Act may be cited as the Clear Grocery Pricing Act.
2 In this Act, "food product" means a food product intended for human consumption.
3 This Act does not apply to a merchant in respect of food products offered for sale in connection with restaurant services.
4 A merchant who offers for sale a food product to which the harmonized sales tax applies shall include the harmonized sales tax in the price indicated for the product.
5 A merchant who offers to a consumer a sale price for a food product that is lower than the price at which it is usually offered for sale shall clearly and legibly indicate the regular price next to the sale price.
6 (1) A merchant who offers to a consumer who is a member of a loyalty program a sale price for a food product that is different from the price offered to other consumers shall clearly indicate both prices next to each other.
(2) The price offered to a consumer who is a member of a loyalty program must be indicated in characters that are no more than 25% larger than the characters used to indicate the price offered to other consumers.
7 (1) A merchant who offers a price for the purchase of a set of food products shall clearly indicate next to the price of the set whether any food products belonging to the set are available to be purchased separately and, where so, the price of those individual food products.
(2) The price offered for the purchase of the set of food products must be indicated in characters that are not smaller than the characters used to indicate the prices of the food products belonging to the set that are available to be purchased separately.
8 (1) The Governor in Council may make regulations respecting any other matter that the Governor in Council considers necessary or advisable to carry out effectively the intent of this Act.
(2) The exercise by the Governor in Council of the authority in subsection (1) is a regulation within the meaning of the Regulations Act.
