An Act Prohibiting Non-disclosure Agreements
with Political Parties

1 This Act may be cited as the Non-disclosure Agreement Prohibition Act.

2 In this Act,

"complainant" means a person who has, or alleges to have, experienced sexual assault or harassment by a member of a political party;

"member of a political party" includes a member of the House of Assembly, an employee of a caucus office and a staff member employed by a Provincial political party or the House of Assembly;

"non-disclosure agreement" means an agreement between a complainant and a respondent or a responsible party that prohibits or restricts a complainant from disclosing information concerning sexual assault or harassment or alleged sexual assault or harassment that the complainant has experienced;

"respondent" means a member of a political party who committed or is alleged to have committed sexual assault or harassment against the complainant;

"responsible party" means a member of a political party who has a legal obligation to take reasonable steps to terminate sexual assault and harassment in the place where sexual assault and harassment occurred or is alleged to have occurred.

3 No respondent and no responsible party may enter into a non-disclosure agreement with a complainant.
