Explanatory Note

This Bill requires education at centres and through programs of the Atlantic Provinces Special Education Authority to be conducted in person.

An Act to Amend Chapter 194
of the Revised Statutes, 1989,
the Atlantic Provinces Special Education Authority Act

Be it enacted by the Governor and Assembly as follows:

1 Chapter 194 of the Revised Statutes, 1989, the Atlantic Provinces Special Education Authority Act, is amended by adding immediately after Section 9 the following Section:

    10 (1) Subject to subsections (2) and (3), education at centres and through programs of the Authority must be conducted in person.

    (2) Classes and programs may be provided through electronic means if the Superintendent of the Authority and the parent or guardian of a person admitted to a centre or enrolled in a program have agreed to an individual education program for the person in which some or all of the education is provided through electronic means.

    (3) The Governor in Council may, by order, suspend in-person education at centres and through programs for a period of not longer than 90 days.

    (4) An order referred to in subsection (3) may be renewed.
