An Act to Establish
Mobile Care Teams for Mental Health

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Mental Health Mobile Care Teams Act.

2 In this Act,

"health authority" means the provincial health authority, as defined in the Health Authorities Act;

"mobile care team" means a mobile care team created under subsection 3(1).

3 (1) Subject to Section 6, the health authority shall create, train and fully fund mobile care teams of trauma-trained mental healthcare professionals in each management zone, as defined in the Health Authorities Act.

(2) A mobile care team shall provide in-home mental healthcare on the same day that care is requested to persons in the Province who are mentally or physically unable to leave their home.

(3) Care offered by a mobile care team must include assessment, appropriate immediate care, referrals and the creation of a safety plan.

(4) A mobile care team shall provide counselling and information to family members, caregivers and support persons of the person receiving care.

4 (1) A family member or caregiver of a person may contact a mobile care team on the person's behalf.

(2) Notwithstanding Section 31 of the Personal Health Information Act, a mobile care team may collect personal health information, as defined in that Act, necessary for the assessment or treatment of the person from the person's family member or caregiver when a request is made for in-home mental healthcare.

5 The mobile care team that provided care shall contact each person who receives care from the mobile care team within 24 hours of care being provided to determine whether further care is required and to make arrangements and referrals for further care, if necessary.

6 The money required for the purpose of this Act must be paid out of money appropriated for that purpose by the Legislature.
