Explanatory Note

This Bill

(a) requires the Minister of Service Nova Scotia to make regulations that require grocery retailers to identify unit prices; and

(b) creates requirements for the regulations.

An Act to Amend Chapter 92
of the Revised Statutes, 1989,
the Consumer Protection Act,
Respecting Transparent Grocery Pricing

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Transparent Grocery Pricing Act.

2 Chapter 92 of the Revised Statutes, 1989, the Consumer Protection Act, is amended by adding immediately after Section 28A the following Section:

    28B (1) Within six months of the coming into force of this Section, the Minister shall make regulations that require a grocery retailer to clearly identify the unit price of items sold in its store.

    (2) Regulations made under subsection (1) must

    (a) have been developed in consultation with relevant stakeholders, including

      (i) people with lived experience living with disabilities,

      (ii) small business owners, and

      (iii) anti-poverty advocates;

    (b) include any necessary definitions;

    (c) identify any grocery retail items or classes of grocery retail items that are exempt from the regulations; and

    (d) require a standardized practice of unit price measurement and signage that

      (i) provides retail consumers with sufficient information to effectively compare retail prices and make informed purchasing decisions, and

      (ii) meets accessibility standards.

    (3) The exercise by the Minister of the authority in subsection (1) is a regulation within the meaning of the Regulations Act.
