Explanatory Note

This Bill requires provincial parks to be open during the winter but provides that no winter maintenance is required and that winter use is at one's own risk.

An Act to Amend Chapter 367
of the Revised Statutes, 1989,
the Provincial Parks Act,
to Keep the Parks Open during the Winter

Be it enacted by the Governor and Assembly as follows:

1 This Act may be cited as the Provincial Winter Parks Act.

2 Section 3 of Chapter 367 of the Revised Statutes, 1989, the Provincial Parks Act, as amended by Chapter 30 of the Acts of 1992, Chapter 9 of the Acts of 1993 and Chapter 29 of the Acts of 2018, is further amended by

(a) striking out the period at the end of clause (o) and substituting a semicolon; and

(b) adding immediately after clause (o) the following clause:

    (p) "winter" means that part of the year as determined by the regulations.

3 Clause 13(i) of Chapter 367 is repealed.

4 Chapter 367 is further amended by adding immediately after Section 13A the following Sections:

    14 Provincial parks must remain open during the whole year.

    14A (1) No winter maintenance of provincial parks is required.

    (2) Persons using a provincial park during the winter do so at their own risk if appropriate signs are posted warning users that there is no maintenance and that use is at one's own risk.

    (3) For greater certainty, the Province has no liability, because of no winter maintenance, for use of a provincial park during the winter if signs are posted in accordance with subsection (2).

5 Subsection 37(1) of Chapter 367 is amended by adding immediately after clause (a) the following clause:

    (aa) determining the part of the year that is winter;
