Explanatory Note

This Bill prohibits hospital patients from being charged fees for long-term care.

An Act to Amend Chapter 197
of the Revised Statutes, 1989,
the Health Services and Insurance Act,
to Provide Fairness in Long-term Care Fees

Be it enacted by the Governor and Assembly as follows:

1 Chapter 197 of the Revised Statutes, 1989, the Health Services and Insurance Act, is amended by adding immediately after Section 10 the following Section:

    11 Where a patient in a hospital has been transferred to or assessed as alternate level of care and is waiting in hospital for an available place in long-term care, no long-term care fees may charged to the patient.
