Explanatory Note

This Bill requires the Minister of Labour, Skills and Immigration to publish all orders made by the Director of Labour Standards to employers respecting a failure to comply with the Labour Standards Code. The orders must be published in a searchable online database and remain on the database for a minimum of 10 years.

of the Revised Statutes, 1989,
the Labour Standards Code,
Respecting Publication of Director's Orders

Be it enacted by the Governor and Assembly as follows:

1 Chapter 246 of the Revised Statutes, 1989, the Labour Standards Code, is amended by adding immediately after Section 21 the following Section:

    21A (1) The Minister shall publish all orders made by the Director under Section 21 in a searchable online database accessible to the public.

    (2) Before publishing an order pursuant to subsection (1), the Minister may remove from the order any personal information about an individual that the Minister considers appropriate to remove.

    (3) All orders must remain in the database for a minimum of ten years from the date the order is first published.
