Explanatory Note

This Bill requires the Minister to provide full coverage for the Fluzone High-Dose Quadrivalent vaccine for seniors.

An Act to Amend Chapter 7
of the Acts of 2011,
the Fair Drug Pricing Act,
Respecting Influenza Vaccine for Seniors

Be it enacted by the Governor and Assembly as follows:

1 Section 2 of Chapter 7 of the Acts of 2011, the Fair Drug Pricing Act, is amended by adding immediately after clause (t) the following clause:

    (ta) "senior" means a person 65 years or more of age;

2 Chapter 7 is further amended by adding immediately after Section 11 the following Section:

    11A (1) Notwithstanding subsection 10(1), the Fluzone High-Dose Quadrivalent vaccine is deemed to be designated as a benefit under that subsection.

    (2) Notwithstanding subsections 11(1) and (2) but subject to subsection (4), the Minister shall provide full coverage of the cost of the Fluzone High-Dose Quadrivalent vaccine in the benefit list established under Section 11 for seniors.

    (3) No copayment or deductible may be charged in connection with the Fluzone High-Dose Quadrivalent vaccine for seniors.

    (4) The money required for the purpose of this Section must be paid out of money appropriated for that purpose by the Legislature.
