Explanatory Note

This Bill requires

(a) all facilities licensed under the Homes for Special Care Act to be equipped with generators that have a minimum four-day energy capacity; and

(b) the Government to provide financial support for the installation costs of the generators.

An Act to Amend Chapter 203
of the Revised Statutes, 1989,
the Homes for Special Care Act,
Respecting Power Outages in Long-term Care

Be it enacted by the Governor and Assembly as follows:

1 Chapter 203 of the Revised Statutes, 1989, the Homes for Special Care Act, is amended by adding immediately after Section 12 the following Section:

    12A (1) Subject to subsection (2),

    (a) all residential care facilities, homes for the disabled, homes for the aged or nursing homes must be equipped with generators that have a minimum energy capacity of four days; and

    (b) the Government shall pay a one-time grant to licensees for the installation costs of the generators.

    (2) The money required for the purpose of this Section must be paid out of money appropriated for that purpose by the Legislature.

2 Subsection 19(1) of Chapter 203, as amended by Chapter 9 of the Acts of 2007 and Chapter 17 of the Acts of 2010, is further amended by adding immediately after clause (v) the following clause:

    (va) respecting all matters related to generator installation and grant payments for the purpose of Section 12A;
